Terms of Service

These Terms of Service ("Terms") govern your use of Echois, a private memory journal application operated by Echois ("we," "us," or "our"). By creating an account or using the app, you agree to these Terms.
Using Echois
Echois is a personal journaling service designed for adults to document their life, which may include family memories with children. Children do not create accounts or submit data directly. You must be at least 13 years old to use Echois. By using the app, you represent that you meet this requirement.
You are responsible for maintaining the security of your account credentials. Do not share your login information with others.
Your Content
You retain full ownership of everything you write, photograph, or record in Echois. By using the service, you grant us a limited license to store, display, and process your content solely to provide the service to you.
You are responsible for the content you create. You agree not to use Echois to store or share content that:
- Violates any applicable law or regulation.
- Infringes the intellectual property rights of others.
- Is harmful, threatening, or abusive toward others.
- Contains malware or other malicious code.
We do not review your journal content and will not access it except to the extent required to operate and maintain the service, or as required by law. Some optional features — AI photo descriptions and AI-personalized writing prompts — send limited content to our AI processing partners, as described in our Privacy Policy.
Shared Journals
Echois offers two ways to connect with others, and you control both:
- Shared journals (co-authors). You can invite people to co-author a shared journal. Once accepted, a co-author can view every entry in that journal until you remove their access. Free accounts may join one shared journal; creating a shared journal or co-authoring more than one requires Plus.
- Connections. You can invite people as connections at no cost. Connections only see the individual entries you choose to share to your feed — never your full journal.
You are responsible for managing who you invite under either model. We are not responsible for how invited members use content they can access.
Subscriptions and Billing
Echois offers a free tier and a paid Plus subscription. Paid plans are billed on a recurring basis through the Apple App Store or Google Play Store. All billing is handled by the respective app store platform and is subject to their payment terms.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period.
- You can manage or cancel your subscription in your device's app store account settings.
- We do not offer refunds for partial billing periods. Refund eligibility for app store purchases is subject to the Apple App Store or Google Play refund policies, which apply independently of our policy.
Free accounts have unlimited entries and one photo per entry, and can join one shared journal. Plus adds up to five photos and two videos per entry, voice memo transcription, tags, the archive (The Shelf), and the ability to create and co-author more than one shared journal.
Service Availability
We aim to keep Echois available at all times, but we do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you in advance of planned downtime.
Account Termination
You may delete your account at any time through the app or by contacting us. Upon deletion, your content will be permanently removed within 30 days.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
Disclaimers
Echois is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or uninterrupted. Your use of Echois is at your own risk.
Echois is a personal memory and journaling tool, not a mental health service, therapy, or crisis resource. Nothing in the app constitutes professional advice of any kind. If you are experiencing a mental health emergency, please contact a qualified professional or call or text 988 (Suicide and Crisis Lifeline).
Limitation of Liability
To the fullest extent permitted by law, Echois shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including loss of data or loss of profits.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of Echois after changes take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
